INFORMATION ABOUT THE NORTH CAROLINA REGISTER AND ADMINISTRATIVE COE 



NORTH CAROLINA REGISTER 

The North Carolina Register is published bi-monthly 
and contains information relating to agency, executive, 
legislative and judicial actions required by or affecting 
Chapter 150B of the General Statutes. All proposed, ad- 
ministrative rules and amendments filed under Chapter 
150B must be published in the Register. The Register 
will typically comprise approximately fifty pages per 
issue of legal text. 

State law requires that a copy of each issue be pro- 
vided free of charge to each county in the state and to 
various state officials and institutions. The North Carolina 
Register is available by yearly subscription at a cost of 
one hundred and five dollars ($105.00) for 24 issues.

Register should be directed to the Office of Ad- 
ministrative Hearings, P. O. Drawer 27447, Raleigh, N. 
C. 27611-7447, Attn: Subscriptions. 

ADOPTION, AMENDMENT, AND REPEAL OF 
RULES 

An agency intending to adopt, amend, or repeal a rule 
must first publish notice of the proposed action in the 
North Carolina Register. The notice must include the 
time and place of the public hearing; a statement of how 
public comments may be submitted to the agency either 
at the hearing or otherwise; the text of the proposed 
rule or amendment; a reference to the Statutory 
Authority for the action and the proposed effective date. 

The Director of the Office of Administrative Hearings 
has authority to publish a summary, rather than the 
full text, of any amendment which is considered to be 
too lengthy. In such case, the full text of the rule con- 
taining the proposed amendment will be available for 
public inspection at the Rules Division of the Office of 
Administrative Hearings and at the office of the pro- 
mulgating agency. 

Unless a specific statute provides otherwise, at least 
30 days must elapse following publication of the pro- 
posal in the North Carolina Register hetore the agency 
may conduct the required public hearing and take ac- 
tion on the proposed adoption, amendment or repeal. 

When final action is taken, the promulgating agency 
must file any adopted or amended rule for approval by 
the Administrative Rules Review Commission. Upon ap- 
proval of ARRC, the adopted or amended rule must be 
filed with the Office of Administrative Hearings. If it 
differs substantially from the proposed form published 
as part of the public notice, upon request by the agen- 
cy, the adopted version will again be published in the 
North Carolina Register. 

A rule, or amended rule cannot become effective 
earlier than the first day of the second calendar month 
after the adoption is filed with the Office of Ad- 
ministrative Hearings for publication in the NCAC. 

Proposed action on rules may be withdrawn by the 
promulgating agency at any time before final action is 
taken by the agency. 

TEMPORARY RULES 

Under certain conditions of an emergency nature, 
some agencies may issue temporary' rules. A temporary 
rule becomes effective when adopted and remains in 



effect for the period specified in the rule or 18( 
whichever is less. An agency adopting a tempora 
must begin normal rule-making procedures on t

adopted.

EXECUTIVE ORDER NUMBER 157 

WAIVING CERTAIN PENALTIES PURSUANT 

TO CHAPTER 1 66 A OF THE GENERAL 

STATUTES OF NORTH CAROLINA 

WHEREAS, this year's cotton and peanut 
crops are the largest in recent years; and 

WHEREAS, substantial portions of the crops 
may be lost if they are not removed from the 
fields before the onset of winter; and 

WHEREAS, there is a substantial likelihood 
that the farmers of the state will not be able to 
remove their cotton and peanut crops from the 
fields before the onset of winter with the equip- 
ment now available to them for that purpose if 
they are required to adhere to the weight re- 
strictions presently imposed by N.C.G.S. 
§§20-88, 20-96, and 20-118; and 

WHEREAS, under the provisions of N.C.G.S. 
§§166A-4(3) and 166A-6(c)(3), the Governor, 
with the concurrence of the Council of State, 
may waive the penalties for exceeding the weight 
limits imposed by said statutes in the event of an 
imminent threat of widespread damage from a 
natural or man-made accidental cause within the 
meaning of N.C.G.S. §§166A-4(3) and 
166A-6(c)(3); and 

WHEREAS, with the concurrence of the 
Council of State, I have found that because: 

(i) thev must adhere to the weiaht restrictions 
of N.C.G.S. §§20-88, 20-96^ and 20-118, 
farmers wiU be unable to remove their cot- 



ton and peanut crops from the fields before 
the onset of winter, 

(ii) their inabihty to do so likely will result in 
damages to their crops causing them to suf- 
fer losses and, therefore, 

(iii) there is an imminent threat of widespread 
damage from a natural or man-made acci- 
dental cause within the meaning of N.C.G.S. 
§166A-4(3); 

THEREFORE, pursuant to the authority 
vested in me by the Constitution and laws of this 
State and with the concurrence of the Council 
of State, it is ORDERED: 

Section |^ The Division of Motor Vehicles 
shall waive penalties arising under N.C.G.S. 
§§20-88, 20-96 and 20-118 that other%\ise would 
be assessed against vehicles transporting on the 
highways of the State unprocessed peanuts and 
unginned cotton to processing facUities. 

Section 2^ Notwithstanding the waivers recited 
above, penalties shall not be wai\ed: 

(i) in those instances where the vehicle weight 
exceeds the maximum gross vehicle weight 
criteria estabhshed by the manufacturer, or 

(ii) for cotton module trucks having tandem 
axle weights in excess of 44,000 pounds. 

Section 3^ This Order shall be effecti\'e imme- 
diately and shall remain in effect untd February 
1, 1992.

(a) The state will pay each hospital the amount 
determined for inpatient services provided by the 
hospital according to the standards and methods 
set forth in this Section. In all circumstances 
invohing third party payment, Medicaid will be 
the payor of last resort. 

(b) If contributions are made pursuant to 
General Statute 143-23.2 during calendar year 
I'^'^l, the Department has determined that it will 
use them as follows: 

(I) the Department will present the contrib- 
uted funds to the federal government to 
be matched pursuant to federal financial 



participation rules. The total of the con- 
tributed and matched funds hereinafter 
will be referred to as the "Funds" to be 
disbursed in the order set forth in this 
Rule. 

(2) the contributed funds will provide the total 
non-federal share of Medicaid expendi- 
tures made with the Funds. 

(3) up to forty million doUars ($40,000,000) 
of the Funds will be used to fund elimi- 
nation of the taraet day provision [as de- 
scribed m 10 NCAC '26H .0202(h)l for 
fiscal years 1990-91 and 1991-92, and to 
further other State .Medicaid purposes for 
those fiscal years. 

(4) any remaining Funds, not to exceed one 
hundred fortv million dollars 
($140,000,000), wiU be used to make an 
additional pavmcnt adjustment to dis- 
proportionate share hospitals for services 
provided in April, May and June, 1991,

(2) "Board" shall mean the Governor's Waste 
Management Board. 

(3) "Chairman" shall mean the Chairman of 
the Governor's Waste .Management Board. 

(4) "Facility" shall mean any low-level radio- 
active waste facility as defmed in NCGS 
104E-5(9b) and any hazardous waste facility 
as dofmud in permitted under NCGS 
130A-290(a)(9). 

(5) "Hearing Panel" shall mean any group of 
members of the Board appointed by the 
Chairman and delegated b\- him the author- 
ity to hear an appeal. 



(6) "Hearing Officer" shall mean any person to 
whom the Chairman delegates authority to 
hear an appeal.

.0006 RESPONSE TO NOTICE OF APPEAL 

(a) Notice of appeal to the Board will be ac- 
knowledged in writing and a form requesting any 
information necessary to perfect the appeal will 
be mailed to the appellant along with the ac- 
knowledgement. A copy of the letter of ac- 
knowledgement win also be sent to the Chairman 
of the Board of Commissioners and the attorney 
for the county, in the case of an appeal of a 
county tax, or the mayor and attorney for the city 
in the case of an appeal of a city tax. 

(b) Unless an extension is requested and 
granted, the requested information necessary to 
perfect the appeal must be returned within 30 
days of the date the appellant receives the letter 
of acknowledgement or the appeal will be dis- 
missed. The applicant shall send a copy of the 
requested information to the city or county at- 
torney at the same time it is returned to the 
Board. 

(c) The acknowledgement wiU also transmit a 
date for hearing the appeal to be set by the 
Chairman. The date of the hearing shall be 
within 90 days of receipt of the notice of appeal, 
except that at the discretion of the Chairman, the 
date mav be extended for good cause.

appealed shall fde an answer within 20 days from 
receipt of the complet e d application, perfected 
appeal, and shall send a copy of the answer to the 
appellant at the same time it is tiled with the 
Board. 

(b) I'he city or county's failure to file an answer 
shall not constitute waiver of the ettv city's or 
county's rights nor an admission of the 
appellant's allegations.

The Chairm;in shall determine for each panel 
whether the muttor appeal should be heard by the 
fuU board, a panel of board members, or a hear- 
ing officer, and shall notify the parties of the de- 
termination. The Chairman is hereby authorized 
to appoint board members to a panel or a hear- 
ing officer and to delegate to the panel or hearing 
officer authority to hear an appeal. The recom- 
mended decision made at this stage by the full 
board, a panel of the Board members, or a hear- 
ing officer shall be presented to the full board for 
fmal decision.

(a) Employers whose employees receive peri- 
odic radiographs from the Department s mobile 



x-ray unit pursuant to G.S. 97-60 will be charged 
a fee for each employee x-ra\ed. The fee will be 
twelve dollars (Si 2.00) per employee. 

(b) r.mployers will be charged a fee for each 
employee screened by the chest consultant pur- 
suant to G.S. 97-60. The fee for this will be five 
dollars ($5.00) per x-ray.
